“Builder” means a registered property developer or promoter listing properties on the Platform.

“Buyer” means any individual or entity using the Platform to explore or inquire about properties.

“Content” means any text, images, videos, documents, or other material uploaded or shared on the Platform.
2. Eligibility
You must:

Be at least 18 years old.

Have the legal capacity to enter into a binding agreement under the Indian Contract Act, 1872.

For Builders — be a registered entity with all necessary approvals, licenses, and RERA compliance.
3. User Responsibilities
By using the Platform, you agree to:

Provide accurate, current, and complete information during registration and property listing.

Not upload or share unlawful, defamatory, obscene, or infringing content.

Use the Platform only for lawful purposes and in accordance with these Terms.

Maintain confidentiality of your login credentials.
-
Promptly update your account details in case of changes.
4. Property Listings & Accuracy

Builders are solely responsible for the accuracy, completeness, and legality of property listings.

Proptecher does not verify every property listing but may conduct random or targeted verification.

Any disputes arising between Builder and Buyer are to be resolved directly between the parties.
5. Fees & Payments

Some services may be subject to fees, which will be clearly disclosed prior to purchase.

Payments are processed through secure third-party payment gateways.
-
All payments are non-refundable unless otherwise stated in writing.
6. Intellectual Property Rights

All content, trademarks, logos, and design elements of the Platform are the exclusive property of Pyrus Innovations OPC Private Limited.

Users are granted a limited, non-exclusive, non-transferable license to use the Platform.

Unauthorized copying, distribution, or modification of Platform content is prohibited.
7. Prohibited Activities
You agree not to:

Engage in fraudulent activities or impersonation.

Attempt to hack, disrupt, or interfere with Platform operations.

Post misleading, false, or unverifiable property information.

Harvest or collect user data without consent.
8. Third-Party Links
The Platform may contain links to third-party websites. We are not responsible for their content or practices. Accessing such sites is at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law:

We are not liable for any indirect, incidental, special, or consequential damages.

We do not guarantee uninterrupted or error-free access to the Platform.

All transactions between Builders and Buyers are at their own risk.
10. Indemnification
You agree to indemnify and hold harmless Pyrus Innovations OPC Private Limited, its directors, employees, and affiliates from any claims, damages, liabilities, and expenses arising from:

Your use of the Platform.

Your violation of these Terms.

Any dispute between you and another User.
11. Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which forms part of these Terms.
12. Termination of Access
We reserve the right to suspend or terminate your account without prior notice if you violate these Terms or engage in activities that may harm the Platform or its Users.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kangra, Himachal Pradesh, India.
14. Dispute Resolution
In the event of a dispute:

Parties shall first attempt to resolve it amicably through written communication.

If unresolved within 30 days, disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996.

The arbitration seat shall be Kangra, Himachal Pradesh, and proceedings shall be in English.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on the Platform with a revised “Last Updated” date. Continued use after changes implies acceptance.
